I am committed to providing an excellent service. Client satisfaction is one of my top priorities and I try to respond to your creative needs by offering visually and technically appealing designs and friendly and understanding service to achieve all your goals.

The following Terms have been tailored throughout ten years of experience in the Design and IT Industry and are implemented to protect both yourself (“The Client”) and I, Rowan Pereira (“The Designer”).

Note that my trust agreements are subject to change, please make sure you have read the latest version of the Terms & Conditions as stated below, before paying a deposit on a project.

Once a deposit is paid, and the proof is emailed to rp@rowanpereira.co.za I will assume you have read through these Terms & Conditions.


Briefing Stage:

Once communication has been established between The Designer and The Client, the Briefing Stage must begin to attain crucial information regarding the project scope. A quote will then be created, and a 40% deposit will be required for work to begin.

Client Provided Content:

To make sure I provide the best results, I need to receive all content regarding the project before work begins. All text must be provided in Word format. Please make sure the text documents provided are correct and are edited appropriately.

All existing Logo files should be provided in High-Resolution PNG with a transparent background, as well as a vector file of the logo, usually in Open Format – were possible. If a high-quality logo cannot be provided, I cannot accept any responsibility for how the logo may appear in completed projects, digital and print. It is advised to supply a vector file of the logo, or to allow myself, to recreate the logo in vector format.

Any images provided to me, must be cleared free to use or have been paid for with a valid license. I cannot accept the use of images or assets that infringe on any copyrights. I use various sources to find images for projects, both royalty-free and paid stock images. Please visit Unsplash or Adobe Stock for images and assets. I can only provide paid assets from Adobe Stock. Please limit your searches to these sites.

Rights and Ownership:

The client shall be entitled to full ownership of all Final Artwork created during the project upon full payment of the agreed-upon fee. All products remain the property of The Designer until fully paid for. No artwork will be supplied without full payment.

Any stock assets purchased for a project will be made available only when requested. These assets will belong to you to the limits of the following: Stock assets are valid to you for up to 500,000 copies or views; Unlimited web views; use in email and mobile marketing, social media and broadcasting; Cannot use prominently in merchandise or products for resale.

Client Feedback:

The Client should be prepared to offer initial feedback as to how closely the suggested concepts and designs meet their needs and expectations. The Client should select the design/concepts or strategies that best suit their needs and assemble and deliver a list of any desired discussion points for revision.

The Client is encouraged to provide examples, feedback and suggestions on designs. The Client can also feel free to combine elements, colours, or ideas from multiple concepts to create a Final look.

Once all revisions have been exhausted, or The Client is happy with a result, The Client will be required to sign off/approve the final design.

Third-Party Contracts:

Any involvement or necessity for third party contractors must be discussed before a project can begin. No project will commence on the assumption that third parties might be required, The Client may request or be advised that I will need to include a third party.

I will not be held liable for any loss or damages occurring after Final Artwork is sent to a supplier or third party. Please be sure to check Final Artworks. Proof prints and final proofs will need to be signed off before commencing with projects done through suppliers and third parties.


Web Process:

It is in my ability to complete a website within 30 working days, as long as The Client supplies me with all the relevant information within 7 working days after the deposit payment unless otherwise arranged.

A mutually agreed upon date should be established, in advance, on which the website should go live.

It is crucial that hosting and the required domain be ready before the project can start. Domain transfers must be done before the project can start. It is also important that I have access to the domain Control Panel (Cpanel) within the first week of the design/development of the project.

The above is important for a painless and seamless production. After these steps are completed the design process can begin.

During the design process, a mock-up concept design will be developed based on the brief. The concept will include the Home/Index page and a live test page.

After receiving feedback on the design and live test site, changes will be implemented and a full version of the site will be created. The site will then be prepared for The Clients domain. E-commerce sites should be developed on The Clients domain.

Existing Websites:

In the case of existing websites, the process must include time for me to log in to your Control Panel, WordPress admin or other to view the files and technologies/scripting languages used for the website.

In certain cases, I cannot guarantee certain work to be done based on the code or technologies used. I can, however, refer The Client to a Third Party.

It can also be advised by myself to redesign, restructure or update the site upon looking at the Control Panel or WordPress Admin.

Hosting Services:

I offer shared Linux hosting from 3GB to 5GB. Hosting is billed on the last day of each month. The Client may request to cancel their hosting at any time. Upon cancellation, the domain will be placed on hold for 30 days.

Web Services:

Monthly Web Services and Packages are billed on the last day of the month and include hosting, maintenance, security and support. The Client may request to cancel or transfer their Web Service or Package at any time. Upon cancellation or transfer, the Web Service or Package will be backed up and arrangements will be made to transfer the files, or the domain over to The Client.

Missed Payments:

If The Client should miss a payment, a reminder will be emailed to The Client. If within 10 days of receiving the email, The Client still has not Paid, a call will be made requesting payment.

If a payment is not made within 30 days, the domain will be backed up and The Client will be notified that the domain will be cancelled within 24hrs, and the website will be removed.


Completed websites, including SQL databases, will be backed up as soon as the website is ready to go live. This backup will be supplied to the client. Monthly backing up of the website and databases can be done as part of a maintenance fee or package.


Search Engine Optimisation:

Websites are designed and developed with SEO in mind – On-Page SEO basics are done for websites.

Any SEO attempts are largely benefited by paid advertising. Although SEO can help direct a website to be more user and search engine friendly, SEO alone cannot provide high rankings. An Advanced SEO and Digital Marketing strategy can include multiple channels and approaches and requires a key understanding of The Clients audience and The Clients message.

Search Engine and Social Media Marketing/Management:

A full strategy should be designed for any Search Engine or Social Media marketing projects. It is important to define goals and deadlines. It is also important that a budget is agreed upon and paid cordially. Any late payments on campaigns can affect analytics and campaign progress.

A strategy must be agreed upon before work can start. It is important to note that The Client must adhere to schedules and requirements regarding marketing strategies in order to achieve the desired goal.

It is also important to note that results may not be guaranteed.



The Client is required to pay a 40% deposit before work commences. The project will only be scheduled once the deposit is received. The deposit is non-refundable. The remaining 60% is payable upon final approval and completion of the project Brief before the Final Artwork is provided to The Client.

No money or deposits for projects will be paid back to The Client at any time during or after the project.

File Formats:

Fully paid for designs will be provided to The Client in Open File and Print-Ready format. Open Format files are provided for printing purposes only. No editing by The Client will be possible without Compatible software.

Errors and Omissions:

I will not be held responsible for proofreading any designs or supplied texts. The Client is responsible to check Versions/Drafts and proofs and other deliverables carefully for accuracy in all respects, ranging from spelling to technical illustrations and graphs.

I am not liable for errors or omissions on a design or deliverable once Final Artwork has been signed-off. The client’s signature or go-ahead instruction (Phone/Email), or that of an authorised representative is required on all artwork before release for printing, digital publication or other implementation or release.

Customer Service:

In the result The Client is not satisfied (due to the Brief being misunderstood, process issues or reasonable expectation is not met), The Client needs to call a meeting with Myself and mediate a favourable solution for both parties.


I retain the right to use the digital and final formats of all completed designs for publication or other promotional purposes. The artworks will be used only for these purposes to market and display work done by Myself. No completed works will be altered or changed, and The Client’s brand will always be held to the highest respect.


Due to the nature of the design industry, it is important to give credit to contributors. Credits, referrals, and word of mouth are incredibly important for a designer or creator to be able to keep doing what we do. Any credits to Myself or any Third parties will be discussed, with The Client, before any publication or release of materials. I will endeavour to be as respectful to your brand, regarding the placement and frequency of the credit.


I can be reached by a phone call or message, or email from Monday to Friday between 09:00 am to 5 pm. Only urgent changes or requests through WhatsApp will be accepted during the weekend at my discretion.

All revisions to be supplied in written format, no revisions will be started based only on telephonic requests/discussions.


The Client must inform me in writing before the project commences if any portion of any material or information provided by The Client is confidential. I will accept any agreements for confidentiality when appropriate and applicable.

Rights of Refusal:

I will not include in any designs or Final Artworks, any text, images or other data that is immoral, offensive, obscene or illegal. All advertising material must conform to all standards defined by relevant advertising authorities. I also reserve the right to refuse including submitted materials without giving a reason.

Any images or data that happens to be included in any completed designs or projects by Myself, in good faith, that contravene this section of the Terms and Conditions, The Client is obliged to allow Me to remove or change the contravention without penalty. I am not to be held responsible for any such data being included.

Force Majeure:

I cannot be liable for any failure or delay in supply or delivery of products/services where such failure or delay is wholly or partly due to any cause or circumstances whatsoever outside the reasonable control of Myself, including but not limited to strikes, lockouts, industrial disputes or unrest, government restrictions or transport delays, fire, power outages, failure attributable to hosting suppliers, breakdown of plant, theft, vandalism, riots, civil commotions, accidents of any kind.
